Schedule 2, Part 5
The claim window drops from two years to 90 days
From 1 December 2026 a claim for an NDIS amount must be made within 90 days rather than two years, so a provider that bills late loses the payment unless another provision saves the claim.
What does the provision require?
Item 89 replaces the period in paragraph 45A(5)(a) with 90 days. The section deals with when a claim for payment of an NDIS amount must be made. The change is short in the text and large in effect: the outside limit for a claim falls from two years to three months.
The Part contains no other amendment and no transitional provision. The Act does not state a discretion to extend the 90 day period in this item. Any extension would have to come from another provision of the Act or from the rules, and the text of the item itself provides none.
Why does it matter to an insurer or a provider?
This is a cash flow and receivables event for every provider, and a policy wording event for every insurer that covers NDIS claim recoveries. A provider with a slow invoicing cycle, or a plan manager with a backlog, will lose claims that would have been paid under the old limit. An insurer that indemnifies a provider for a rejected claim should check whether the rejection flows from a missed 90 day window, because that is a process failure rather than a funding decision.
What did the amendment change?
The period changes from two years to 90 days. Nothing else in the section changes, and the Part has no savings or transitional rule, so the new period applies from 1 December 2026 without a stated grandfathering.
Suggested evidence
These are the publisher's control suggestions, not statutory requirements. The provision's own requirement is above; an auditor or regulator decides what is sufficient.
- The claim lodgement date for each claim, measured against the support date
- The invoicing and billing cycle, and the longest interval between support and claim
- The plan manager's claim submission log
- Any claim rejected for lateness and the amount
- The policy condition that assumes a longer claim window
What should be done before the date?
- Measure the current support to claim interval across the portfolio
- Change the billing cycle before 1 December 2026
- Review any policy condition or reserve that assumes a two year claim window
- Add a late claim report to the monthly risk pack
What the text does not say
The text does not state an extension power in this Part. It does not say whether a claim made before 1 December 2026 but decided after that date is measured under the old or the new period.
